These terms and conditions, in conjunction with the privacy policy, are applicable to your Lotus’s account which includes the My Lotus’s Membership and online shopping using the mobile application (“Lotus’s App”) and/or website at [www.lotuss.com.my]. Any participation by way of registration of a My Lotus’s Membership Account and/or online purchases would amount to acceptance of the terms and agreement to abide by the said terms and conditions. Terms and Conditions:
• This promotion is valid on every Tuesday from 7 January 2025 until further notice.
• This promotion is only applicable for purchases on Lotus’s Shop Online via the website or app.
• 1,000 My Lotus’s Points will be rewarded for any transaction of RM180 or more.
• The 1,000 My Lotus’s Points will be credited to the customer’s account within 14 working days from each promotional day.
• We reserve the right to change, modify, add, or remove portions of these Terms and Conditions at any time. Changes will be effective without prior notice.
F. Guide Price
1. Please note that the prices displayed on Lotus’s Shop Online website are guide prices and in estimation only. The total amount of guide prices shown in the Customer’s shopping trolley and order confirmation email may differ from the Customer’s final bill.
1. The variance between guide prices and the Customer’s final amount charged will be due to one or more of the following reasons: -
i. Weighted products
The guide prices on the website are based on estimated weighted products of respective fruits and/or vegetables, but the final price to be paid will be based on the exact weight of the product you selected, which may vary from the guide price. However, the base price per kg/g of the weighted product will remain the same as per the price on the checkout date.
ii. Technical/System errors – Should there be any price discrepancies relating to technical and/or system errors beyond our control, we reserve the right to amend your Order and/or the total amount of your Final Bill to ensure the actual price to be paid is properly recorded. We will endeavour to communicate with you regarding such price changes before the acceptance of your Order and/or before payment is made.
iii. Rejected product – If you are dissatisfied with the revision of your Order and/or the total amount of your Final Bill and/or the price differences of your products resulting from the technical and/or system errors mentioned above, you are entitled to reject the said products upon delivery. You will not be charged for any products you have rejected.
If the value of the product delivered is higher than the value stated in the order confirmation or if the Customer considers that the difference between the price charged and the guide price shown on the website is unacceptable, the Customer has every right to reject the product. The amount of the product rejected will not be charged to the Customer’s payment card if he/she has provided payment card details in advance for payment online.
The actual price to be paid by the Customer will be the amount displayed and charged in-store at the time the order is confirmed at checkout. The final order value can only be determined on the delivery day, as the guide prices on the website may vary due to factors such as product substitutions, rejections, or price differences for weighted product.
The actual price of certain product may differ from the guided price initially quoted on the Lotus’s Shop Online website on the delivery day. If the delivered product are priced higher than what was initially stated in the confirmed order or if the Customer finds the price difference between the amount charged and the guided price unacceptable, the Customer has the right to reject the product The Customer will not be charged for any rejected product.
For any weighted product requests, we reserve the right to supply such weighted product with some variance and/or difference in weight due to the nature of this category. However, we shall make every effort to ensure the weight difference is minimal and as close to Customer’s request.
The cost of the delivery services is not included in the price of the product. The information about the cost of the services will be made available on the Lotus’s Shop Online website as soon as the Customer books a delivery slot.
G. Product Terms & Conditions
a. General
These Product Terms & Conditions shall be governed by and construed in accordance with the laws of Malaysia and any disputes will be decided only by the Malaysian courts.
If any of these Product Terms & Conditions are held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms & Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
This Lotus’s Shop Online website is owned and operated by Lotuss Stores (Malaysia) Sdn Bhd (Registration No. 200001018812 (521419-K)) (“Lotus's”).
Please read these Product Terms & Conditions carefully as they affect your rights and liabilities under the law and set out the terms under which we make the products available to you ("Product Terms").
b. Availability
The availability of the product presented on the Lotus’s Shop Online website will depend on the stock availability in stores and is usually reflected on the website on the viewing day. However, we do not guarantee the availability of product on the day of delivery.
In order to ensure that product are available to all customers, we reserve the right to set maximum purchase limit for each product by a single Customer. For example, if the Customer makes an order of 10 bottles of chilli sauce which would use up all the stock of that store, the store may allow a maximum purchase limit of 5 bottles of chilli sauce only instead of 10 bottles of chilli sauce.
The Customer shall always be notified in advance if the product requested cannot be delivered by reason of exceeded purchase limit of the said product
c. Acceptance
There will be no contract of any kind between the Customer and us unless and until we actually dispatch the product to Customer. Customer’s order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually dispatch the product to Customer. At any point up until then, we may decline to supply the product to Customer without giving any reason. The moment the product are dispatched (and not before), a contract will be formed between us and Customer, and Customer will be charged for the product.
The Lotus’s Shop Online service is available for non-commercial and domestic use only. We reserve the right to refuse orders from businesses or that we consider are for commercial or other non-domestic concerns.
To ensure availability of all our products customers may be limited to purchase a restricted and/or maximum number of products only.
d. Delivery
Delivery will be made to the address provided in the order form completed by the Customer.
We will only deliver the Customer’s order up to the main entrance and/or the respective residential and/or corporate’s designated drop off and/or receiving area of the delivery address only.
Please be informed that all deliveries will be made without any packaging and/or plastic bags. Therefore, Customers are required to prepare their own reusable bags and/or any other form of carrier to collect and/or receive the product delivered to them.
The Lotus’s Shop Online delivery service is available only in selected areas. You are able to check and/or determine whether we deliver to a specific area when you input the delivery address either during the registration of your Lotus’s membership account, or when you input the delivery address for your order to be delivered.
Delivery times will be agreed with the Customer at the time the Customer place an order and book the delivery slot.
Each selectable delivery period have limited slots available. Therefore, there is no guarantee that you will be able to choose the delivery period you desire. When the slots for respective delivery periods has been fulfilled or optimized, the said delivery period will be inaccessible and the same will be indicated on the Website or in the Lotus’s App. The delivery period shall always be confirmed and agreed upon before the placement of your Order.
Lotus’s Malaysia may employ Independent Contractor to ensure the delivery of Product is fulfilled within the timeframe of the selected delivery period stated on the Website and/or Lotus’s App. Delivery may not be available during rain or severe weather condition. Neither Lotus’s Malaysia or the Independent Contractor shall be held liable for any losses, liabilities, costs, damages, charges or expenses arising out of any delay, postponed or cancelled delivery. If the Product are not delivered within the timeframe of your selected delivery period (except during bad weather condition), or if you have any other inquiry regarding delivery, please contact our customer service department, as indicated on the Website and/or Lotus’s App.
There is a minimum spending requirement as indicated on the Website and/or Lotus’s App to be entitled for delivery services. The delivery charges for each delivery period may vary depending on the demand of each slot. Furthermore, the delivery charges may increase depending from the chosen timeslot to your Delivery Address.
All risk in the Product shall pass to you upon acceptance of delivery of the Product.
Our riders/drivers will only wait for fifteen (15) minutes upon arrival at your selected delivery address. If you are unable to collect your Product and/or refuse, delay, fail and/or neglect to respond to our riders/drivers’ call/text/ any form of communications regarding the collection of Product within the agreed timeframe, the Order will be classified as a ‘failed delivery’ and the rider will return to the Premises with all the products. Service fee and delivery charges are still applicable and chargeable to the Customers.
At the time of Delivery of Product, you must ensure adequate arrangements, including the necessary access for our riders/drivers, are in place for the safe delivery of such Product.
Our drivers/riders shall not be held responsible and/or liable for any losses, damages, costs or expenses incurred to such Product or premises in the following scenarios:
(i) your failure to provide adequate access or arrangements for delivery of the Product;
(ii) where delivery is made in your absence, you request that riders/drivers leave the Product at your designated place and/or with a designated recipient;
All product must be received by an adult aged 18 years and above (“legal age”). If the driver has doubt over the age of the person receiving the product, he is entitled to ask such person to show an identity card to prove his/her age. If the recipient is not of legal age, and there is no other person of legal age who can receive the product, then the riders and/or drivers has the right not to complete the delivery the product.
If there is nobody qualified to receive the product at the agreed time and place specified by the Customer, we will leave notification of attempted delivery and Customer will need to contact customer services to re-arrange delivery. Additional costs shall apply to re-arrangement and subsequent delivery of the product.
If payment is to be made by card or any acceptable e-wallet upon delivery, the cardholder and/or the owner of e-wallet must be present.
If Customer requests for redelivery, we are entitled to charge for providing the service.
Whilst we make every effort to deliver all Customer product within the agreed time, we shall not be held liable for any failure to do so in part or in full due to inevitable circumstances beyond our control.
e. Returns & Refunds
When you buy from the Lotus’s Shop Online website, we want you to be happy with your purchase. However, we know sometimes you may need to return product. This policy sets out when you can return product, and how to do so.
If you change your mind
If you change your mind, we offer a refund or exchange of certain goods within certain time periods (please see the table below).

You should please take reasonable care of the goods whilst they are in your possession (reasonable care includes inspecting goods, but would not extend to your opening certain goods, for example, sealed cleaning products).
If you have received faulty or damaged goods
You may hand any faulty or damaged goods back to the driver at the time of delivery for a refund or return to our Hypermarket store printed on the delivery documents (with proof of purchase) for a refund or exchange. At the Customer Services desk you can request a refund.
When you return goods
Customer shall return goods at his/her own cost. Goods returned shall be refunded at the price which the Customer had paid at the point of delivery.
Please note that, in the event of a refund, all Clubcard points received for the purchase of the refunded goods will be removed from Customer Clubcard account.
For the avoidance of doubt, this provision does not affect the rights of the Customer for non-acceptance of substituted goods.
Please note that, in the event of a refund, all My Lotus’s points received for the purchase of the refunded goods will be removed from customer account.
f. Cancellation
Customer can cancel or change any of Customer’s current orders up to 6pm on the evening before the order is due for delivery via the app and web. If in an emergency, the Customer needs to cancel the order after this time, Customer may contact Customer Services and we will try our best to help.
Please note that orders cannot be cancelled by email.
g. Payment
You can usedebit or credit card to pay for your shopping online. We accept the following payment providers, issued by banks in Malaysia:
There are 2 types of payment method which is offered by Lotus’s Shop Online, Pay at Door and Pay Online
i) Pay at Door
If you choose to Pay at Door by either a debit or credit card or any Lotus’s acceptable e-wallet including but not limited to Touch ‘n Go e-wallet. For this option, you will be asked to present the payment card during acceptance of the order. You will only be charged for your shopping when your products are delivered to you.
ii) Pay Online
If you choose pay online either with a debit/ credit card, you must provide your payment card details before your Order is delivered. To ensure your shopping online is secure, your debit/credit card details will be encrypted for security reasons and prevention of fraud (if any). Your credit card issuer may also conduct security checks to confirm such Order is genuine and from the cardholder.
You agree that for debit card or credit card payments and/or the adding of new cards under the payment method of your Lotus’s Malaysia account, Lotus’s will pre-authorize a small sum for card verification purposes to the respective issuing banks. You will not be charged for this amount.
You agree that by saving your card details on any of our platforms you are allowing us to make recurring charges to your card when you have confirmed orders. These charges are made without the need to insert your security one time pins (OTP).
We regret to inform you that we do not accept cash as payment for your shopping as our Company policy do not allow the same and it is also for the safety of our drivers.
The final payment will be charged upon delivery;
(i) if your Total Bill amount is higher than the amount charged during Checkout, your payment card will be charged a second time via recurring charges for the balance between your Checkout amount and final Total Bill. Some banks may send a notification regarding a second charge. If your payment card transaction is declined for this second charge, we will request for the additional amount to be transfer to Lotus’s Malaysia bank account.
(ii) if your final Total Bill amount is lower than the amount paid during Checkout, the balance will be refunded in accordance with your bank’s standard practices; and (iii) If your Total Bill amount is the same as the amount during Checkout, no additional charges or refunds will be processed. Your bank will update the final charge on your statement accordingly after delivery
Our liability to you in connection with any order will not exceed the total price charged for the relevant product.
General
a. disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material;
b. transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice;
c. gaining unauthorised access to other computer systems;
d. interfering with any other person's use or enjoyment of the Lotus’s Website;
e. breaching any laws concerning the use of public telecommunications networks;
f. making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.
10. You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out or in connection with:
a. any claim by any third party that the use of the Lotus’s Website by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice;
b. any claim by any third party that the use of the Lotus’s Website by you infringes that third party's copyright or other intellectual property rights of whatever nature; and
c. any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the Lotus’s Website by you.
a. incompatibility of the Lotus’s Website with any of your equipment, software or telecommunications links;
b. technical problems including errors or interruptions of the Lotus’s Website;
c. unsuitability, unreliability or inaccuracy of the Lotus’s Website;
d. inadequacy of the Lotus’s Website to meet your requirements.
To the full extent allowed by applicable law, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Lotus’s Website.
